CONSUMER
PROPOSAL
A
Consumer Proposal is an arrangement with your creditors to pay
off all or a portion of your debt, or to extend the payment period of the
debt or in some situations, a combination of both. A Proposal must conform
to the regulations set out in the Bankruptcy and Insolvency Act and must be prepared
by a Trustee in Bankruptcy such as Davis Daignault Schick.
A
Consumer Proposal can only be filed by an individual who owes less than
$75,000, excluding the debt secured by a principal residence.
A
Consumer Proposal cannot extend over more than 5 years.
Is a Consumer Proposal a viable option for me?
If you can afford to pay at least a portion of your debts then a Consumer
Proposal may work for you. A Stay of Proceedings goes into effect upon the filing a Consumer Proposal, which prevents unsecured creditors from
commencing or proceeding with collection action until the Proposal is
dealt with. A Consumer Proposal generally provides for one monthly payment
to be made to the "Administrator" who must be a Trustee in Bankruptcy.
A
Consumer Proposal is similar to a Loan-Consolidation eliminating the
need to pay many creditors at the same time.
You
will be required to attend 2 financial counseling sessions during the
period of the proposal.
